Refund Policy – Orbitpay
Introduction
This Refund Policy governs all refund-related matters for transactions processed through OrbitPay and applies to all users, merchants, and entities using the platform.
By registering with OrbitPay or using its services, including Pay-In (Payment Gateway) and Payout services, you acknowledge that you have read, understood, and agreed to this Refund Policy. This Policy forms an integral part of the Terms of Service and shall be binding on all users.
Nature of OrbitPay Services
OrbitPay provides a technology platform that facilitates digital payments through UPI integrations with authorized banks and regulated financial institutions.
OrbitPay is not a bank and does not hold any payment system license. It does not receive, hold, or settle funds. All transactions are processed, authorized, and settled entirely by partner banks and UPI network systems.
As a result, all refunds, reversals, and settlement timelines are governed by the respective banking partners and applicable regulatory guidelines. OrbitPay’s role is limited to enabling the transaction flow and providing technical support.
Merchant Responsibility for Refunds
All refund obligations arising from transactions processed through OrbitPay shall rest solely with the respective merchant or service provider.
OrbitPay is not responsible for the nature, quality, delivery, or performance of any product or service offered by the merchant. In case a customer raises a refund request due to non-delivery, delay, dissatisfaction, or any related issue, it is the responsibility of the merchant to review and process such requests as per their own policies.
Any financial liability related to refunds shall be borne entirely by the merchant, and no claim shall be made against OrbitPay.
User Responsibility
Users are advised to carefully verify all transaction details before initiating any payment.
OrbitPay shall not be responsible for incorrect transactions resulting from user errors, including incorrect UPI ID entry, wrong recipient details, or incorrect payment amounts.
Processing of Refunds
Where a refund is approved by the merchant, the amount shall be processed back to the original source of payment through UPI, unless otherwise agreed between the merchant and the customer.
The time required to process refunds depends entirely on the banking systems and UPI network involved. OrbitPay does not guarantee any specific timeline for refund processing, as these timelines are determined by partner banks and regulatory frameworks.
OrbitPay may assist in facilitating communication between the parties but does not control or expedite the refund process.
Failed Transactions
In cases where a transaction fails but the amount is debited from the user’s account, the refund will be processed as per the guidelines issued by the Reserve Bank of India (RBI) and the respective bank.
OrbitPay will make reasonable efforts to coordinate with its banking partners for resolution. However, any delay caused by banking systems or UPI networks shall not be attributed to OrbitPay.
Charges and Non-Refundable Fees
All transaction fees, service charges, processing fees, or applicable taxes charged at the time of the transaction are non-refundable.
Even in cases where a transaction is reversed or refunded, such charges may still apply as per the policies of partner banks or financial institutions. OrbitPay shall not be liable to refund any such charges unless explicitly stated otherwise.
Recovery of Refund Amounts
In the event that a refund or reversal creates a financial liability for a merchant, the merchant authorizes OrbitPay to recover the corresponding amount from their available balance, settlements, or future receivables.
If sufficient balance is not available, the merchant shall be required to deposit the outstanding amount within the specified time. Failure to do so may result in suspension of services, withholding of settlements, or further action as deemed necessary.
Risk Management and Withholding Rights
OrbitPay reserves the right to monitor transaction patterns and refund behavior. In cases of excessive refunds, disputes, or suspicious activities, OrbitPay may impose certain controls such as delaying settlements, withholding funds, or restricting services.
These measures are necessary for risk management and compliance with partner bank requirements.
Limitation of Liability
OrbitPay’s role is limited to providing a technical platform for facilitating transactions.
OrbitPay shall not be held liable for any delays, failures, or discrepancies in refund processing caused by banks, UPI systems, or other third-party service providers. All such processes are governed by external institutions, and OrbitPay’s responsibility is limited to coordination support.
Indemnity
By using OrbitPay services, merchants agree to indemnify and hold harmless OrbitPay, its directors, employees, and partners from any claims, losses, or liabilities arising from refunds, disputes, or transaction-related issues.
This includes any claims made by customers due to the merchant’s failure to fulfill their obligations.
Dispute Resolution
Any disputes related to refunds must be raised within a reasonable time through official support channels.
OrbitPay may assist in coordinating with partner banks or institutions; however, the final resolution shall be subject to the policies and decisions of the respective bank or payment system involved.
Policy Updates
OrbitPay reserves the right to update or modify this Refund Policy at any time without prior notice. Updated versions will be published on the website and will become effective immediately.
Continued use of the platform shall be considered acceptance of the revised Policy.
